Castlevania Disabling EFB copy on DX9 after launching the Game

Description

What steps will reproduce the problem?
1.Launch Castlevania Wii with EFB copy active texture or RAM DX9

What is the expected output? What do you see instead?
The screen will go black until the video intro who seems fine.(same prob with DX11)
But after you stop the game and go to config you will see EFB copy deactivated and when you try to reactive it by rechecking the box and go back to config the box is unchecked again.
You have to quit dolphin and start it for keeping EFB copy active.
Dolphin version with the problem?

r5767 32b or 64

OS version and versions of tools/libraries used?
win7 64b/ quad core nvidia GT230

it do the same with OGL by checking the disable box
